The scientific substantiation of food and supplement claims is currently under significant and lengthy review by regulatory agencies, particularly in the EU and US, which will ultimately have global implications. In general, statements related to the prevention, treatment, cure or mitigation of disease (or symptoms of disease) are drug claims. Drug claims require pre-market approval and registration of the product in most, if not all, jurisdictions. Those related to reducing the risk of disease also require pre-market approval as health claims. Those related to the structure or function of the body may be allowed depending on the local jurisdiction. It is important that food and supplement manufacturers ascertain for themselves the legality of any claims on their finished consumer products in the relevant regions.
